Many business owners assume that they may begin operating as soon as the company has been incorporated, a lease has been signed and the equipment has been installed. In practice, however, a wide range of activities may be classified as a “business hazardous to health” and require prior permission from the local competent official in Bangkok.
The Bangkok Metropolitan Administration Ordinance on Businesses Hazardous to Health B.E. 2561 (2018) identifies controlled business activities and sets out requirements relating to premises, sanitation, applications, inspections, licensing and renewal. The licensing position should therefore be reviewed before committing to a lease or fitting out the premises. Early review can help prevent unsuitable investment, delays in opening, or costly remedial work following an official inspection.
Which businesses should check their licensing status?
The Ordinance groups controlled activities into 13 principal categories:
• Businesses involving animals, including breeding, keeping, nursing or collecting animals.
• Businesses involving animals and animal products, including slaughtering, storing or processing animal parts and manufacturing animal feed.
• Businesses involving food, beverages and drinking water, including the manufacture, storage or packing of various foods, ice, drinking water and beverages.
• Businesses involving medicines, medical supplies, medical equipment, cosmetics and cleaning products.
• Agricultural businesses, including the production or packing of vegetable oils, drying or fumigating agricultural produce and manufacturing fertiliser.
• Businesses involving metals or minerals, including manufacturing metal containers and melting, welding, cutting or plating metals.
• Businesses involving motor vehicles, machinery or mechanical equipment, including manufacturing, repairing, washing, pressure cleaning, spray painting and battery production.
• Businesses involving wood or paper, including sawing, planing, drilling, furniture production, paper production and manufacturing paper products.
• Service businesses, including beauty salons, fitness premises, theatres, laundries, laboratories and certain elderly-care services.
• Textile businesses, including spinning, weaving, bleaching, dyeing, printing, washing and cleaning textile products.
• Businesses involving stone, earth, sand, cement or similar materials, including crushing, grinding, mixing and producing concrete, glass or mirrors.
• Businesses involving petroleum, petrochemicals, coal, chemicals and flammable materials.
• Other specified businesses, including printing, candle making, bottle cleaning, pest-control services and producing or repacking alcohol or ethanol.
Important: A commercial trade name may not correspond directly to the wording used in the Ordinance. Classification should be based on the activities actually carried out, the materials used, operational processes, machinery, production capacity and use of the premises.
What conditions must the premises satisfy?

• The location must be suitable, must not create a nuisance and must have convenient access.
• Drainage surfaces should be smooth, impermeable and leak-free, with wastewater directed to an appropriate receiving or treatment system.
• Wastewater and other waste must be treated or managed in accordance with the relevant laws.
• Lighting, ventilation and working space must be sufficient for safe operations.
• Adequate clean water, toilets, handwashing facilities and hygienic waste and sewage arrangements must be provided.
• Raw materials, products, chemicals, hazardous materials and equipment must be stored safely and in a manner that prevents contamination.
• The operator must maintain cleanliness, control pests and disease vectors, prevent nuisances and protect workers’ health and safety.
• Any specific directions or conditions imposed by the local competent official or public-health official must be followed.
Application process in Bangkok
1. Classify the actual business activities — Review the premises, processes, raw materials, machinery and production capacity to identify the relevant controlled category.
2. Identify the responsible district office and special requirements — The application is made to the local competent official at the district office for the area in which the premises are located. Confirm any additional district-specific documentation or conditions.
3. Prepare the application and supporting documents — The Ordinance prescribes Application Form Aor.Phor. 1 and related forms. Supporting documents may vary depending on the activity and whether the applicant is an individual or legal entity.
4. Prepare the premises for inspection — Review ventilation, wastewater, waste storage, sanitation, safety and the internal layout before the official visit.
5. Submit the application and undergo inspection — Officials review the application, supporting evidence and hygiene conditions. Where a deficiency is capable of correction, the applicant may be instructed to amend the application, provide further evidence or rectify the premises within a specified period.
6. Pay the fee and collect the licence — Once permission has been granted, the applicant must pay the prescribed fee within the applicable period. Failure to pay may be treated as abandonment of the right to receive the licence.
7. Monitor renewal and operational changes — Under the cited Ordinance, the licence is valid until 31 December of the year in which it is issued. Changes to, expansion or reduction of the business, premises or machinery must follow the prescribed procedure.
Documents commonly required
Although the Ordinance prescribes the application forms, the supporting documents may depend on the district office, category of business, applicant and building. The following should generally be prepared in advance:
• Application form for a licence to operate a business hazardous to health.
• Applicant’s identification card and house registration, or the company affidavit and documents of the authorised director.
• Power of attorney and the attorney-in-fact’s documents, where applicable.
• Evidence of the right to use the premises, such as a lease, owner’s consent or ownership document.
• Location map, site plan and internal floor plan showing operational areas, machinery, drains, toilets, waste-storage points and other material features.
• Description of the operational process, raw materials, products, machinery, horsepower, number of employees and operating hours.
• Building, environmental, safety or other regulatory documents required for the particular activity.
